This website does not have login/user accounts. However, the third party we use for scheduling and billing requires user accounts. Please read their Terms & Conditions.

Except as described otherwise, all materials in the Website are made available only to provide information about Worry Free Pet Care, Inc. or its designee, controls and operates this site from its headquarters in Waukee, Iowa, United States of America and makes no representation that these materials are appropriate or available for use in other locations

You agree to indemnify, defend and hold harmless Worry Free Pet Care, Inc. and its affiliates, and their officers, directors, employees, contractors, agents, licensors and suppliers, from and against any and all losses, liabilities, expenses, damages and costs, including reasonable attorneys’ fees and court costs, arising or resulting from any violation of these Terms and Conditions. If you cause a technical disruption of the Website or the systems transmitting the Website to you or others, you agree to be responsible for any and all losses, liabilities, expenses, damages and costs, including reasonable attorneys’ fees and court costs, arising or resulting from that disruption.

12. Dispute Resolution

You and Worry Free Pet Care, Inc. Agree to give up any rights to litigate claims in a court or before a jury or to participate in a class action or representative action with respect to a claim. Other rights that you would have if you went to court, such as access to discovery, also may be unavailable or limited in arbitration.

Any dispute between you and Worry Free Pet Care, Inc. and its agents, employees, officers, directors, principals, successors, assigns, subsidiaries or affiliates (collectively for purposes of this section, “Worry Free Pet Care”) arising from or relating to these Terms and their interpretation or the breach, termination or validity thereof, the relationships which result from these Terms, including disputes about the validity, scope or enforceability of this arbitration provision (collectively, “Covered Disputes”) will be settled by binding arbitration in Dallas County, Iowa administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, in effect on the date thereof. Prior to initiating any arbitration, the initiating party will give the other party at least 60-days’ advanced written notice of its intent to file for arbitration. Worry Free Pet Care, Inc. will provide such notice by e-mail to your e-mail address on file with Worry Free Pet Care, Inc. and you must provide such notice by e-mail to contact@worryfreepets.com with “Legal Dispute” appearing in the subject line. During such 60-day notice period, the parties will endeavor to settle amicably by mutual discussions any Covered Disputes. Failing such amicable settlement and expiration of the notice period, either party may initiate arbitration.

Payment of all filing, administration and arbitrator fees will be governed by the AAA’s rules. If, however, you are able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Worry Free Pet Care will pay as much of the filing, administration and arbitrator fees as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive for you. If the arbitrator determines the claim(s) you assert in the arbitration are frivolous, you agree to reimburse Worry Free Pet Care for all fees associated with the arbitration that Worry Free Pet Care paid on your behalf, which you otherwise would be obligated to pay under the AAA’s rules.

The arbitrator will have the power to grant whatever relief would be available in court under law or in equity and any award of the arbitrator(s) will be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction. The arbitrator will not, however, have the power to award punitive or exemplary damages, the right to which each party hereby waives, and the arbitrator will apply applicable law and the provisions of these Terms and the failure to do so will be deemed an excess of arbitral authority and grounds for judicial review. Worry Free Pet Care and you agree that any Covered Dispute will be submitted to arbitration on an individual basis only. Neither Worry Free Pet Care nor you are entitled to arbitrate any Covered Dispute as a class, representative or private attorney action and the arbitrator(s) will have no authority to proceed on a class, representative or private attorney general basis. If any provision of the agreement to arbitrate in this section is found unenforceable, the unenforceable provision will be severed and the remaining arbitration terms will be enforced (but in no case will there be a class, representative or private attorney general arbitration). Regardless of any statute or law to the contrary, notice on any claim arising from or related to these Terms must be made within one (1) year after such claim arose or be forever barred. For purposes of this section, these Terms and related transactions will be subject to and governed by the Federal Arbitration Act, 9 U.S.C. sec. 1-16 (FAA).

13. Geographical Scope of the Website

Worry Free Pet Care, Inc. controls and operates the Website from within the United States. Unless otherwise specified on the Website, the Website is intended to promote only those Worry Free Pet Care, Inc. services that are delivered by Worry Free Pet Care, Inc.

This English-language set of terms Worry Free Pet Care’s official statement of its terms of use for all the Website. In case of any inconsistency between these English-language set of terms and its translation into another language, these English-language Terms prevail.

14. Miscellaneous

These Terms and Conditions will be governed and be interpreted pursuant to the laws of the State of Iowa, United States of America, notwithstanding any principles of conflicts of law, and you hereby consent to the exclusive jurisdiction and venue of courts in Iowa in all disputes arising out of or relating to the use of the Website. Use of the Website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Worry Free Pet Care, Inc. as a result of these Terms and Conditions or use of the Website. Worry Free Pet Care, Inc.’s performance of this Terms and Conditions is subject to existing laws and legal process, and nothing contained in this Terms and Conditions is in derogation of Worry Free Pet Care, Inc.‘s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Website or information provided to or gathered by Worry Free Pet Care, Inc. with respect to such use. If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms and Conditions shall continue in effect. A printed version of these Terms and Conditions and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Worry Free Pet Care, Inc. services are available in many parts of the United States. However, the Website may describe services that are not available Nationwide.
